Privacy Policy

This Privacy Policy applies to the Bushwak mobile application (hereinafter referred to as the “Application”), developed by J. Nye (hereinafter referred to as the “Service Provider”) as an ad-supported service. The Application is provided “AS IS”.

Information Collection and Use​

User-Provided Information​

The Application may collect information you voluntarily provide when downloading, registering, or using the Application. Registration with the Service Provider is optional. However, certain features (such as saving sightings or syncing data) may require registration.

If registration is offered, the Service Provider may collect information such as your email address, display name, or other details necessary to create and manage your account.

The Service Provider may also use your contact information to:

  • Provide important notices or updates regarding the Application
  • Send marketing or promotional messages (only if you have consented to receive them)

You can opt out of promotional communications at any time by following the unsubscribe instructions provided in those messages.

Automatically Collected Information​

The Application may automatically collect certain information, including but not limited to:

  • The type and model of your mobile device
  • Device identifiers (such as advertising ID or device ID)
  • IP address and approximate location
  • Operating system and mobile browser type
  • Usage information (such as interactions with app features and screens viewed)

This information is primarily used for analytics, app functionality, and service improvements.

Location Information​

The Application may collect approximate or precise location data only when you grant permission within the app. This location data is used to:

  • Enable features such as logging sightings and viewing nearby wildlife
  • Display relevant maps, sightings, and navigation routes
  • Improve the user experience through analytics and performance insights

You can disable location access at any time in your device settings. The Application does not continuously track your location in the background.

Third-Party Access and Data Sharing​

Only aggregated and anonymized data is periodically transmitted to third-party services to help improve the Application and its functionality.

The Application uses third-party services that may collect information used to identify you. Below are the links to their respective privacy policies:

If advertisements are displayed within the Application, third-party ad networks (such as Google AdMob) may collect or use data (such as device identifiers) to personalize and measure ads. These networks operate under their own privacy policies.

The Service Provider may also disclose information:

  • When required by law or legal process
  • When disclosure is necessary to protect rights, property, or safety
  • To trusted service providers operating under confidentiality agreements who assist in app operations and maintenance

Opt-Out Rights​

You can stop all information collection by uninstalling the Application. You may use the standard uninstall processes available on your device or through your mobile app marketplace.

You may also revoke location access or ad personalization permissions in your device settings.

Data Retention and Management​

The Service Provider will retain user-provided data for as long as your account is active or as needed to provide the service. Automatically collected data may be retained for up to 24 months and thereafter stored in aggregated form.

If you wish to delete any data you have provided, contact contact@bushwak.com. The Service Provider will respond within a reasonable time and delete data as permitted by law. Please note that deleting certain data may impact the functionality of the Application.

Children’s Privacy​

The Application is not intended for children under the age of 13. The Service Provider does not knowingly collect personally identifiable information from children. If such data is discovered, it will be deleted immediately.

If you are a parent or guardian and believe your child has provided personal information, please contact contact@bushwak.com so appropriate action can be taken.

The Service Provider complies with applicable data protection laws, including the General Data Protection Regulation (GDPR) for users in the European Union and the California Consumer Privacy Act (CCPA) for U.S. users.

You have the right to:

  • Request access to or deletion of your personal data
  • Withdraw consent for data processing
  • Request correction of inaccurate data

Security​

The Service Provider is committed to safeguarding your data. Physical, electronic, and procedural measures are in place to protect against unauthorized access, use, or disclosure.

While reasonable security measures are applied, please note that no system is entirely immune to breaches or unauthorized access.

Changes to This Policy​

This Privacy Policy may be updated periodically. For significant updates, the Service Provider will notify users through in-app messages or update notes within the app marketplace.

You are encouraged to review this Privacy Policy regularly. Continued use of the Application after changes are posted will be considered acceptance of the updated terms.

Effective Date: February 9, 2025

By using the Application, you consent to the collection and processing of information as described in this Privacy Policy, including any future amendments.

“Processing” means any operation performed on personal data — including collecting, storing, using, combining, or disclosing information.
